These Terms of Service ("Terms") are a legal agreement between you and Section Blue LLC ("Section Blue," "we," "us," or "our"), a California limited liability company, governing your use of the Atlas mobile application (the "App") and the website at sectionblue.app (the "Website") (collectively, the "Services").

By downloading, installing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services. If you are under 18, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

2. License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, as permitted by the Apple App Store Terms of Service. This license is for your personal, non-commercial use unless otherwise agreed in writing.

You may not:

  • Copy, modify, distribute, sell, lease, sublicense, or create derivative works of the Services;
  • Reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law;
  • Extract, scrape, or redistribute the station directory or other data the App provides, other than through the sharing features the App offers;
  • Use the Services in violation of any applicable law or regulation;
  • Interfere with or disrupt the integrity or performance of the Services, or of any broadcaster's stream;
  • Remove or alter any proprietary notices in the Services.

3. Subscription and Free Trial

3.1 Atlas Unlimited

The App is free to download. Some features require Atlas Unlimited, an auto-renewing subscription. Pricing and the subscription period are displayed in the App before you subscribe. All subscriptions are purchased through Apple and billed to your Apple Account; we do not collect or store your payment card information.

3.2 Free Trial

New subscribers may be offered a free trial. Unless you cancel at least 24 hours before the trial ends, your subscription begins automatically and your Apple Account is charged the price shown in the App. Free trial eligibility is limited to one trial per Apple Account and may be modified or withdrawn for new subscribers at any time.

3.3 Renewal and Cancellation

Your subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. You can manage or cancel your subscription at any time in your device's Settings under your Apple Account, or from the Subscription section of the App's settings. Cancelling stops future renewals; you keep access until the end of the period already paid for.

3.4 Refunds

Payments are processed by Apple, and refunds are governed by Apple's policies. To request a refund, visit https://reports.apple.com/problem or contact Apple Support. Except where required by law, payments are non-refundable.

EU/UK consumers: By subscribing and accessing digital content immediately, you acknowledge and consent that the statutory 14-day withdrawal period does not apply once performance has begun, to the extent permitted by applicable law. This does not affect your mandatory statutory rights, including legal guarantees for digital content.

3.5 Price Changes

We may change subscription prices. Apple will notify you of any price increase in advance, and, where required, ask for your consent before it takes effect. If you do not agree, you may cancel before the increase applies.

4. Stations and Third-Party Content

Atlas is a directory and a player. The radio stations available in the App are broadcast by third parties who are not affiliated with us. We do not own, control, edit, or endorse their programming, and we make no promise that any station will be available, will play without interruption, or will carry any particular content. Stations may change, go offline, or be removed from the directory at any time.

The station directory is built from public sources, including radio-browser.info, GeoNames (under the CC BY 4.0 licence), Wikidata, and Ofcom's published lists of UK stations (public sector information licensed under the Open Government Licence v3.0). Station locations are approximate.

The globe's imagery and map data are provided by Esri and its data partners and are subject to Esri's terms.

You are responsible for your own use of the App, including complying with the laws of your jurisdiction and with any terms a broadcaster attaches to its stream. The App is not intended for emergency or safety-critical use.

5. Intellectual Property

The Services, including all software, designs, text, graphics, logos, and other content (excluding third-party broadcasts and third-party data described in Section 4), are owned by Section Blue LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 2, no rights are granted to you.

6. Apple App Store Terms

These Terms are between you and Section Blue LLC only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. The following applies to your use of the App downloaded from the Apple App Store:

  • Your license to use the App is limited to a non-transferable license to use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions;
  • Apple has no obligation to furnish any maintenance or support services for the App;
  • In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App;
  • Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection or similar legislation;
  • In the event of a third-party claim that the App infringes intellectual property rights, Section Blue, not Apple, is responsible for the investigation, defense, settlement, and discharge of such claim;
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties;
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY STATION WILL BE AVAILABLE OR ACCURATELY LOCATED.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. If you are a consumer in the EU or UK, nothing in these Terms affects your statutory rights, including legal guarantees of conformity for digital content and services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SECTION BLUE LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR ANY THIRD-PARTY BROADCAST, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US$50).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or gross negligence. If you are a consumer in the EU or UK, we are liable to you as required by mandatory consumer protection law.

9. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Section Blue LLC and its officers, members, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Services. This section does not apply to consumers in jurisdictions where such indemnification obligations are unenforceable.

10. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or if we reasonably believe your use poses a risk to us, the Services, or others. You may stop using the Services at any time; cancelling a subscription is described in Section 3.3. Sections that by their nature should survive termination (including Sections 5, 7, 8, 9, and 11) will survive.

11. Governing Law and Disputes

11.1 Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. If you are a consumer residing in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protection laws, you additionally benefit from any mandatory provisions of the law of your country of residence, and nothing in these Terms deprives you of that protection.

11.2 Disputes

We encourage you to contact us first at [email protected] so we can try to resolve any dispute informally. Subject to Section 11.3, any dispute arising out of these Terms or the Services will be resolved exclusively in the state or federal courts located in California, and you consent to their jurisdiction — except that if you are an EU or UK consumer, you may bring proceedings in the courts of your country of residence.

11.3 EU Online Dispute Resolution

If you are an EU consumer, you may also be entitled to use alternative dispute resolution mechanisms available in your country of residence. We are not obligated to and do not participate in dispute resolution proceedings before a consumer arbitration board unless required by law.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date above and, where appropriate, provide notice through the App or Website. Changes will not apply retroactively. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms. If you do not agree, stop using the Services.

13. General

  • Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Section Blue LLC regarding the Services.
  • Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.
  • Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Export Compliance. You agree to comply with all applicable export and sanctions laws.
